Representation may be on an hourly basis for a specified amount per hour. The
attorney bills his/her time for work performed for the client and the client receives a bill each month which includes an
amount for the hourly work (and costs). Some
cases are accepted on a contingency fee basis. This means that the attorney receives a fee for work performed
only if we are successful in obtaining money for you from the defendant. Money may be obtained by settling the case or by
winning the trial and collecting on the judgment. Cases accepted on a contingency fee basis include personal injury or workers
compensation cases, as well as products liability and medical malpractice cases.
Some services are provided for a flat fee. Preparation of a Will,
a Designation of Patient Advocate (sometimes called a "living will") or Durable Power of Attorney are billed for
a flat fee. Routine new business startups are also billed for a flat fee.
Your attorney will explain the fee options available at your first meeting.
Each client pays the costs associated with his
or her case, no matter what the arrangement is for fees. Costs in court case might include filing fees charged by the court,
the cost of a court reporter to produce a deposition transcript, travel expenses of the attorney for traveling to and from
court, copying costs, postage, as well as any other costs attributed to the file. In most cases, you will receive a monthly
bill for costs connected to your case.
