Fred Boncher:
  • Fred Boncher is currently working on a number of cases involving trespass and the unauthorized cutting of trees by both power companies and an individual. In one of these cases, there are also issues involving violations of the Wetlands Protection Act and diversion of a stream. In addition, Mr. Boncher has a number of automobile personal injury cases in which he is presently engaged. These involve several motorcycle accident cases including one in which the plaintiff lost a leg as a result of the defendant running a stop sign, another in which two occupants of the motorcycle were struck from behind by a drunk driver, and a third in which our client was struck by an elderly woman who failed to yield the right-of-way and ran a stoplight. Other motor vehicle accident cases in which Mr. Boncher is involved include cases involving a stolen vehicle and other intersection collisions.

    With respect to construction cases, Mr. Boncher recently brought suit against a municipality for failure to pay for work performed on a sewer water project, is defending a case involving allegations of improper roadway subbase, is defending two separate cases involving declaratory judgment actions brought by insurance companies to avoid coverage, is representing a non-profit housing corporation against a construction company that negligently constructed sewer lines which resulted in the freezing of the sewer lines and backup of sewage into low income housing units and is involved a malpractice case against an architectural/engineering firm involving a project near Torch Lake.

    Mr. Boncher is also involved in a case against an accounting firm for misrepresentations involving the leveraged buyout of two companies for several million dollars, a case in Federal Court involving disability insurance for a doctor and a federal case involving claimed violations of the wage and hour laws.

    Appellate cases being presently handled by the firm and Mr. Boncher include a case against a rock classification machine purchased by one of the firm’s mining clients, a case involving a fall from a scaffolding that was improperly erected, one of several successful manufacturing sales representative cases which was appealed by the defendant to the 6th Circuit Court of Appeals in Cincinnati, Ohio, a  breaches of contract case regarding the purchase real estate and personal property, and an appeal of a declaratory judgment against brought by an insurance company which the firm won on summary disposition.

    The firm has handled several manufacturer sales representative cases and has several now pending involving potential recoveries of several million dollars. In the past, the firm has been successful on several of these cases involving settlements or judgments in the six and seven figure range.

    Mr. Boncher is presently working on two cases involving the destruction of residences by fire including claims against an insurance company and a propane gas supplier.  The firm is presently defending one of his construction company clients involving a motorcyclist who lost control over his motorcycle, drove off the road, and was rendered a quadriplegic as a result of the accident. Other cases recently being handled by Mr. Boncher include probate cases involving disputes among heirs, civil rights cases for age and race discrimination, residential construction cases and the collection of several large judgments for breaches of contract, social security disability claims.  Mr. Boncher is also litigating a case involving contamination of a sports complex facility by excavation from a neighboring railroad bed containing railroad slag which was contaminated with arsenic.

  • Increased foreclosure work.
Brent Boncher:
  • Preparation for trial for wrongful installation of utility lines.  Utility company wrongfully cut large swath of trees on clients' property without proper easement or permit.  Michigan law provides for treble damages.
  • Several cases progressing representing individuals on workmanship issues on construction of new homes.
  • Preparing for oral argument at Michigan Court of Appeals on breach of contract case involving purchase of $500,000 mining machinery (breaches of warranty and misrepresentation issues).  Consequential damages from direct damages are several million dollars.
  • Litigation on several mortgage priority cases.
  • Investigations and discovery into causes of flooding on case where neighbor parcels filled wetlands resulting in flooding around client's home involving MDEQ violations and trespass.
  • Ongoing investigation in arbitration concerning custom commercial/manufacturing software.  Breach of contract issues. 
  • Representation of a condominium association in litigation regarding common area flooding.
  • Ongoing litigation for several residential homeowners which involves poor workmanship and breaches of contract.
  • Representation of contractor client in residential construction project with construction lien and nonpayment of funds owed. 
  • Mr. Boncher is also involved in a number of the cases described under Mr. Boncher (senior) as well.

  •  Preparing for appeal of personal injury case to Michigan Court of Appeals in personal injury (fall from scaffolding negligently erected).
